Maxi Product Co., Inc. (Company) of 112 S. Pearl Street, Janesville, Wisconsin, 53548, warrants to ORIGINAL (End User) Buyer that all equipment manufactured and supplied by Company will be free from defects in material and workmanship for one (1) year from the date of ORIGINAL (End User) purchase OR two (2) years from the date of manufacture, whichever expires first.
Company at Company’s sole option, will correct any such defect by suitable repair or replacement only if Company receives written notice of said defect within the warranty period or within seven (7) days thereafter, and said notice describes with particularity the nature, and extends only to equipment installed and used in accordance with instruction provided to Buyer.
This Warranty is to be used only to cover correction of manufacturing defects. It will not be used to cover: lack of maintenance, operator’s misuse, normal wear, accidents, customer dissatisfaction, harsh environmental deterioration and/or transportation to and from servicing dealer or Company.
THIS WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR other WARRANTY OF QUALITY, WHETHER EXPRESSED OR IMPLIED. No warranties are given beyond those set forth herein. No employee, agent, representative, distributor, sales person or other party associated with the Company is authorized to make or extend warranties beyond those set forth herein. Any such additional representations or statements do not constitute fulfillment of all liabilities of the Company to Buyer with respect to the equipment, whether based on a contract, negligence, strict liability or otherwise.
The Company shall not under any circumstances be liable for special or consequential damages, including, but not limited to, damage or loss of other property or equipment, loss of profits or revenue, cost of capital, cost of purchased or replaced goods, or claims of customers of Buyer, whether attributable to defects in the equipment, delays in delivery, or otherwise. The remedies of Buyer set forth herein, are exclusive, and the liability of the Company with respect to the sale of the equipment or anything done in connection therewith shall not exceed the cost to Buyer of said equipment.
Company makes no warranty with respect to axle assemblies, brake systems, wheels, tires, light systems, hitch couplers, jacks, power units, cylinders or other accessories not manufactured by Company, as these items are warranted by the manufacturer of these items.
